Local Uber Driver Files Lawsuit After Serious Car Accident Caused

BRADENTON, FL [December 12, 2024] – Diego Mauricio Agudelo Restrepo, a local Uber driver, has filed a lawsuit against a local driver and his parents, alleging negligence and spoliation of evidence following a serious car accident. The incident occurred on October 26th, 2024, in Manatee County, Florida, when Mr. Restrepo’s vehicle was struck by a 2009 Subaru Impreza WRX driven by the driver. The driver’s parents are the owners of the Subaru in question.
The complaint alleges that the driver’s negligent driving caused the accident, resulting in serious and permanent injuries to Mr. Restrepo. Furthermore, the suit claims that the driver has a history of reckless driving, evidenced by prior traffic citations. The complaint also names the driver’s parents as defendants, as they are the owners of the Subaru and are alleged to be vicariously liable for the driver’s actions.
Adding to the severity of the case, the lawsuit points to the destruction of the Subaru Impreza WRX by Allstate Insurance, the defendants’ insurer. This destruction, according to the complaint, represents a breach of the insurer’s duty to preserve evidence and severely prejudices Mr. Restrepo’s ability to fully prove his case. The vehicle allegedly contained a data recording system that could have provided crucial evidence regarding the accident.
